H-1B filings were way down this year, and the cap was not even close to being met. USCIS reports that they received approximately 13,500 H-1B petitions counting toward the 65,000 cap. USCIS received approximately 5,600 H-1B petitions for individuals with advanced degrees from a U.S. institution counting towards the annual cap of 20,000. This is great news for employers as they can continue to file H-1B petitions for workers in a specialty occupation in the upcoming months as their business needs require.
All H-1B petitions received before April 7, 2010, will have an April 7, 2010 receipt date. H-1B petitions received on April 7, 2010 or later will bear the actual receipt date. For H-1B petitions submitted for Premium Processing, the clock for the 15 day processing time will start on April 7, 2010.
