H-1B Filings Begin April 1st 2010

Beginning April 1, 2010, the United State Citizenship and Immigration Services (“USCIS”) will begin accepting new H-1B petitions for employment commencing on October 1, 2010. The fiscal year cap for H-1B petitions for FY2011 is 65,000. In addition there are 20,000 H-1B petitions for those with a Masters Degree or higher in the U.S. The quota only applies to new H-1B visas and does not apply to those nonimmigrants who currently hold H-1B status.

While the H-1B cap was not reached until December 21, 2009 this past year, it is expected to be reached much quicker as the U.S. economy is slowly recovering from the recession.
