Department Of State Runs Out Of Immigrant Visas For All Employment Cases

With just under two weeks left in FY-2011, the Department of State Visa Services Department has announced that all immigrant visas for the employment based categories have been used.  The Immigration and Nationality Act places a cap of 140,000 on the number of employment based immigrant visas that can be issued in any fiscal year. 

In their announcement to USCIS, the Department of State instructed that until October 1st no new employment based immigrant visas can be issued, and that any pending cases should held at the visa office until October 3rd when the visa can be issued under the FY-2012 numbers.

The practical effect of this announcement is that immigrants with a current priority date awaiting adjudication should not expect to receive any approval notices for the next two weeks.  To check visa processing times click here.
