Over 320,000 Venezuelans and Burmese currently living in the United States are now eligible to stay and work here for another 18 months. The United States has now designated people from Venezuela or Burma living in the U.S. as eligible for Temporary Protective Status (“TPS”). Moreover, the United States Citizenship and Immigration Services (“USCIS”) has encouraged anyone applying for TPS from Venezuela to register as soon as possible within the 180-day registration period.
Who Can File for TPS: Requirements
- Venezuela: You must show you have lived in the United States since March 9th, 2021
- Burma: You must show you have lived in the United States since March 11th, 2021
- Pass a security and background check.
Benefits of TPS
The most important benefit of TPS is that you are temporarily protected from being deported into danger. According to the United Nations, up to 94 percent of Venezuela’s population lives in poverty, millions without reliable sources of food, water, and medicine. Burma is currently suffering a military coup. Secondly, with TPS you can work. The USCIS will issue an Employment Authorization Document (EAD) that allows you to work until September 9, 2022 so long as the USCIS approves your TPS registration application, you filed Form I-765, Application for Employment Authorization, and paid the fee (or have it waived). In many instances TPS and the accompanying work card can be renewed beyond these initial dates provided the program is extended.
